The legal saga surrounding the alleged falsification of Ousmane Sonko’s signature has taken yet another unexpected turn. Khardiata Tandian, accused in the case, remains behind bars after the Dakar Criminal Court postponed its verdict for the second time.

The original hearing date of July 9, 2026, was adjourned once again, this time to July 23. The tribunal cited the continued absence of a key figure in the proceedings—Chérif Zeyni Abidin Sy, identified as Tandian’s alleged accomplice—as the primary reason for the delay.

Missing witness complicates proceedings

The court has repeatedly emphasized the necessity of hearing all parties involved before delivering a final decision. Sy’s failure to appear at previous sessions has repeatedly stalled the case, and his presence remains a prerequisite for the tribunal to proceed.

Defense pushes for provisional release amid prolonged detention

With the legal process at a standstill, Khardiata Tandian’s legal team filed a motion for her provisional release. The defense argued that all procedural documents had already been submitted, rendering her continued detention unnecessary for the case’s integrity.

The attorney further contended that no risk of witness tampering or evidence tampering existed, as Tandian had already been questioned and all critical acts of the procedure had been completed. The defense also highlighted the harsh personal toll of her incarceration, noting her status as a married mother whose family stability has suffered due to the prolonged detention.

Additionally, the defense pointed out that over a year in prison could potentially cover any sentence she might receive if convicted, making further detention disproportionate.

Prosecution resists release on grounds of public order

The public prosecutor opposed the request, citing concerns over public order and the risk that Tandian might not appear for future hearings. The prosecution argued that her detention was justified to ensure the judicial process’s smooth completion.

After reviewing both arguments, the court sided with the prosecution, rejecting the provisional release motion. Khardiata Tandian will therefore remain in custody until the next scheduled hearing on July 23.

Next steps hinge on accomplice’s appearance

The case now balances precariously on Chérif Zeyni Abidin Sy’s eventual presence in court. His continued absence has repeatedly delayed justice, and his testimony is now viewed as critical to resolving the matter. Unless unforeseen circumstances arise, the tribunal will deliver its verdict on July 23, with Tandian still detained pending the outcome.
