Legal clarity on parliamentary commissions: the justice ministry’s stance

As the National Assembly convened for its first extraordinary session of the 2026-2027 legislative year, parliamentary leaders addressed concerns over the legality of six proposed investigative commissions, each targeting sensitive issues.

Legal framework takes center stage

The president of the National Assembly, Ousmane Sonko, initiated the session by emphasizing the legal boundaries governing such inquiries. « The law explicitly states that parliament cannot establish a commission to examine cases already under judicial review », he stated, adding that he had personally verified compliance with the Minister of Justice.

Sonko further clarified that « following my formal inquiry to the Ministry of Justice, I received confirmation last week that out of the five dossiers in question, only one—pertaining to land management near Dakar’s former airport—remains outside judicial proceedings ».

Session agenda: eleven key legislative items

With a tight 15-day window mandated by the organic law n°2025-11 of August 18, 2025, the session will scrutinize eleven legislative proposals: two private member bills, three government bills, and six requests for parliamentary inquiry commissions. Among the focal points are:

• Land management around Dakar’s former airport
• The « One Student, One Laptop » program
• Revenue losses and tax exemptions
• Fishing license issuance conditions

The proceedings unfold as the government navigates the delicate balance between legislative oversight and judicial independence.
